To Whom Does your Fence Belong?
Fences are often used to create boundaries between gardens in a domestic setting. When fences are working well and doing their job, there is rarely any questions that need to be asked about them. However, if repairs need to be carried out, a fence needs to be replaced, or you want to install a new fence that looks different to the existing one, the question needs to be asked: who does the fence belong to?
There is no hard and fast rule about this, which can make it difficult to work out. You may remember from when you moved in, or your neighbours might know.
If you cannot work it out, the information will be in the deeds for your property, which will show all of the boundaries. You can find this out from your solicitor if you don’t have a copy of the deed yourself. Often neighbours will share the cost of changing fencing, as it does affect both properties despite the rules of ownership.
